Alabama legalized medical cannabis in 2021, but the program comes with a restriction that surprises many residents: home cultivation is illegal for everyone in Alabama, including registered medical patients.

Is Cannabis Legal in Alabama?

Medical marijuana is legal for qualifying patients under the Darren Wesley "Ato" Hall Compassion Act, signed into law by Governor Kay Ivey in May 2021. The Alabama Medical Cannabis Commission (AMCC) oversees the program, and qualifying patients aged 19 and older can access approved non-smokable medical cannabis products — tablets, capsules, tinctures, gels, oils, creams, suppositories, and transdermal patches — through licensed dispensaries with a doctor's certification.

Recreational cannabis remains fully illegal in Alabama. There is no adult-use program, and possession outside the medical system carries real criminal exposure — up to a year in jail and a $6,000 fine for a first offense, with repeat offenses or possession with intent to sell classified as felonies.

Home Cultivation Is Not Permitted — Even for Patients

Alabama's medical program is built entirely around licensed cultivation, not personal growing. Only a small number of state-licensed cultivators (capped at 12 licenses statewide) may legally grow cannabis, and they can only transfer it to other licensed businesses within the AMCC system — never directly to patients.

Growing cannabis outside this licensed system, for any reason including personal medical use, is classified as a Class B felony under Alabama law. This applies equally to registered medical patients; holding a medical cannabis card does not create any exception for home cultivation.

Where Things Stand in 2026

Alabama's medical cannabis program has faced a bumpy rollout — the AMCC initially awarded licenses in 2023, then paused and re-reviewed the process before issuing final licenses to 24 businesses later that year. As of 2026, there's no active legislative movement to add a home-grow allowance to the program. Advocates have raised the idea, but the state's regulatory focus has stayed on licensed, tracked cultivation rather than personal growing rights.

Alabama's approach mirrors much of the Deep South, but stands in real contrast to states like Missouri, where registered adults can grow up to 6 flowering plants at home. Alabama's medical program offers no equivalent path for patients.
