North Carolina remains one of roughly 10 states with no legal cannabis access at all — no medical program, no adult-use market, and no licensed dispensaries anywhere under state law. Home cultivation is illegal in North Carolina under all circumstances, with growing even a single plant treated as felony manufacture.

Is Cannabis Legal in North Carolina?

No, with one notable exception. Marijuana remains fully illegal under North Carolina state law for both medical and recreational purposes. The state does have a narrow affirmative-defense provision for patients with intractable epilepsy who possess low-THC hemp extract, but this falls well short of a real medical program. Possession of half an ounce or less has been decriminalized to a $200 fine, but anything beyond that remains a criminal offense.

The one real exception is tribal sovereign land: the Eastern Band of Cherokee Indians voted in September 2023 to legalize cannabis possession, cultivation, and purchase on the Qualla Boundary. Any adult 21 or older can legally purchase from the tribe's Great Smoky Cannabis Co. with just a valid ID — no North Carolina residency or medical card required. Step off tribal land, though, and North Carolina's state prohibition applies again.

Home Cultivation Is a Felony Statewide

North Carolina treats cannabis cultivation under its manufacturing statute rather than simple possession — even a single seedling can trigger a felony charge, with penalties scaling up sharply based on quantity. Enhanced penalties apply near schools, parks, or when minors are present. The only legal cultivation in the state is industrial hemp under a separate, state-licensed program that has nothing to do with marijuana.

Where Things Stand in 2026

North Carolina's cannabis landscape may be shifting. The state's Advisory Council on Cannabis released an interim report in April 2026 recommending the General Assembly consider an adult-use regulatory model with medical protections, along with a shift toward regulating THC by potency rather than maintaining separate "hemp" and "marijuana" categories. Separately, the federal government's move to reclassify cannabis as a Schedule III substance has added momentum to North Carolina's stalled medical cannabis bill, the Compassionate Care Act, which passed the Senate in 2023 but has repeatedly stalled in the House. Whether any of this translates into actual legislation remains to be seen, and Republican leadership in the General Assembly has shown limited appetite for Democrat-sponsored cannabis bills. For comparison, neighboring Virginia already allows adults 21 and older to purchase and cultivate cannabis legally statewide.
