Enhanced penalties apply near schools, parks, or when minors are present. The only legal cultivation in the state is industrial hemp under a separate, state-licensed program that has nothing to do with marijuana.

Where Things Stand in 2026

North Carolina's cannabis landscape may be shifting. The state's Advisory Council on Cannabis released an interim report in April 2026 recommending the General Assembly consider an adult-use regulatory model with medical protections, along with a shift toward regulating THC by potency rather than maintaining separate "hemp" and "marijuana" categories. Separately, the federal government's move to reclassify cannabis as a Schedule III substance has added momentum to North Carolina's stalled medical cannabis bill, the Compassionate Care Act, which passed the Senate in 2023 but has repeatedly stalled in the House. Whether any of this translates into actual legislation remains to be seen, and Republican leadership in the General Assembly has shown limited appetite for Democrat-sponsored cannabis bills.
