Under Hawaii's medical cannabis program (Act 228 and its amendments), patients holding a valid 329 registration card may legally cultivate up to 10 cannabis plants at home, with no distinction between mature and immature plants under current rules. Cultivation sites must be registered with the Hawaii Department of Health, and plants must be grown in a locked, enclosed space out of public view at the patient's residence or another approved, controlled location.
Recreational cannabis remains illegal in Hawaii, and recreational home cultivation is not permitted — the medical card is the dividing line. Possession of small amounts (up to 3 grams) outside the medical program has been partially decriminalized, resulting in a civil fine rather than criminal charges, but growing without registration still carries serious legal risk, including potential felony charges for larger grows.
