Is It Legal to Grow Cannabis Clones in South Dakota?
Yes, for registered medical patients. Under South Dakota's Medical Cannabis Program, patients may cultivate at home in one of two ways. By default, any qualifying patient can grow up to 3 plants in a secure, locked space not visible to the public. Alternatively, patients can apply for a home cultivation authorization on their registry card application, allowing up to 2 flowering and 2 non-flowering plants — this route requires physician consent and an additional $20 registration fee on top of the standard $75 medical card fee (reduced to $20 for low-income applicants).
Recreational cannabis remains illegal in South Dakota. Voters rejected adult-use measures in 2022 and again in 2024, and a 2020 constitutional amendment that passed was later struck down by the state Supreme Court on procedural grounds. For now, the medical card remains the only legal path to cannabis access and home cultivation.
