Virginia occupies a strange spot in cannabis law: it became the first Southern state to legalize both possession and home cultivation back in July 2021, but recreational retail sales still don't exist. Is It Legal to Grow Cannabis Clones in Virginia?

Yes. Adults 21 and older may legally cultivate up to 4 cannabis plants per household — no medical card or special permit required. This is a household limit, not per person; two or more adults living together still share the same 4-plant cap. Unlike most legal states, Virginia doesn't distinguish between mature and immature plants — the limit is simply 4 total, regardless of growth stage.

Each plant must be tagged with the grower's name, driver's license or state ID number, and a note that it's being grown for personal use — failing to tag carries a modest $25 civil fine. Plants must be kept out of public view and inaccessible to anyone under 21, and cultivation is only permitted at your primary residence. One important restriction: Virginia law specifically prohibits making cannabis concentrates from home-grown plants — flower only.
