Yes. New Jersey voters approved legalization in November 2020 with 67% support, and the CREAMM Act, signed February 22, 2021, established the state's regulatory framework. Adults 21 and older can purchase up to 1 ounce per transaction and possess up to 6 ounces total. Medical cannabis has been legal even longer, since the Compassionate Use Medical Marijuana Act passed in 2010.
Home Cultivation Remains a Felony — Even for Patients
New Jersey's legalization law never extended to home growing. Cultivating any amount of cannabis is a criminal offense — growing between 1 ounce and 5 pounds is a third-degree crime carrying 3 to 5 years in prison and up to a $25,000 fine, with penalties scaling sharply for larger quantities. This applies equally to registered medical patients; there is no cultivation carve-out in the medical program.
New Jersey is grouped with a small number of other legal states — including Illinois, which limits home grow to registered medical patients only — that legalized cannabis sales without fully extending cultivation rights to individuals.
Where Things Stand in 2026
Multiple home cultivation bills are currently pending in the New Jersey Legislature, though none have advanced to a floor vote as of mid-2026. Senate Bill S2564 would allow adults 21 and older to grow up to 6 plants for personal use, with a 12-plant household cap. Companion bills A1674 and S1758 would create a narrower path specifically for registered medical patients, permitting up to 4 mature and 4 immature plants. Advocates argue home grow is a natural extension of legalization; the licensed industry has pushed back, citing concerns about regulatory oversight and tax revenue. Medical-only home grow proposals have historically gained more traction in New Jersey than the broader adult-use versions, though neither has reached a committee vote in 2026.
