Is Cannabis Legal in New Hampshire?

Medical cannabis is legal for qualifying patients under the state's Therapeutic Cannabis Program (RSA 126-X), which allows patients with a physician's certification to register with the Department of Health and Human Services and purchase from licensed Alternative Treatment Centers. Roughly 15,000 patients are currently enrolled, and can possess up to 2 ounces within a 10-day period.

Recreational cannabis remains illegal. New Hampshire did decriminalize small amounts back in 2017 — possession of three-quarters of an ounce or less is a civil fine rather than a criminal charge — but anything beyond that, along with any sale or cultivation, remains a criminal offense.

Home Cultivation Is a Felony — Even for Patients

New Hampshire takes an unusually strict stance on growing: cultivating any amount of cannabis, even a single plant for personal use, is classified as a manufacturing offense and a felony. This applies equally to registered medical patients — there is no home-grow allowance built into the Therapeutic Cannabis Program, and patients must purchase exclusively through licensed dispensaries.

Where Things Stand in 2026

New Hampshire came closer to recreational legalization in early 2026 than in past years. House Bill 186 passed the New Hampshire House on January 7, 2026 by a 208-135 vote, but the Senate tabled it on a party-line 15-9 vote the following month. Governor Kelly Ayotte has repeatedly said she has no interest in signing any cannabis legalization bill, making near-term change unlikely despite the House's repeated willingness to advance similar bills in recent sessions. Separate bills to add home cultivation to the existing medical program (HB 53) and expand possession limits (HB 190) were also tabled in 2026.

With Massachusetts, Maine, and Vermont dispensaries all within a short drive of the New Hampshire border, many residents simply cross state lines for legal access — though bringing cannabis back into New Hampshire remains a federal offense regardless of where it was purchased.
