Cannabis Laws in Washington: What You Need to Know

Washington was one of the first two states to legalize recreational cannabis, back in 2012 — but more than a decade later, it remains one of a small handful of legal states where regular adults still can't grow their own. Recreational home cultivation is not legal in Washington; only registered medical patients may cultivate at home.

Is Cannabis Legal in Washington?

Yes. Washington voters approved Initiative 502 in November 2012, legalizing recreational cannabis for adults 21 and older. Adults can purchase and possess up to 1 ounce of flower from licensed retailers statewide, and the state has one of the most mature legal cannabis markets in the country.

Home Cultivation Remains Off the Table for Most Adults

Washington is one of only a few legal states that never extended cultivation rights to recreational consumers. Registered medical patients can grow up to 6 plants at home — or up to 15 with a physician's specific approval — but adults without a medical authorization have no legal path to home cultivation, regardless of how long cannabis has been legal to buy in the state.

Where Things Stand in 2026

Lawmakers have tried repeatedly to close this gap. Representative Shelley Kloba has introduced home-grow legislation in nearly every session for years — including House Bill 1614 (2023), House Bill 2194 (which passed a House committee in January 2024 before stalling), and the current session's House Bill 1449, prefiled for 2025 and reintroduced in January 2026, along with a companion measure, Senate Bill 6204. Both remain active but unpassed as of mid-2026. Support has come from an unusual coalition — civil liberties advocates, equity groups, and even Scotts Miracle-Gro have lobbied in favor — while opposition has come mainly from substance-abuse-prevention and law-enforcement groups concerned about youth access. As of this writing, adults in Washington still aren't legally allowed to grow cannabis at home without a medical authorization. For comparison, neighboring Oregon allows any adult 21+ to grow up to 4 plants at home with no card required.
