Cannabis Laws in Mississippi: What You Need to Know

Mississippi's medical cannabis program has grown to serve over 67,000 patients since launching in 2023, but the state maintains one of the strictest cultivation policies in the country: home cultivation is illegal in Mississippi for everyone, including registered patients.

Is Cannabis Legal in Mississippi?

Medical marijuana is legal for qualifying patients under the Mississippi Medical Cannabis Act (SB 2095), signed by Governor Tate Reeves in February 2022 after voters had originally approved a similar measure in 2020 with 74% support, only for the state Supreme Court to strike it down on a technicality. Registered patients with a qualifying condition — including cancer, epilepsy, PTSD, chronic pain, and several others — can purchase up to 3 ounces per month through licensed dispensaries, roughly 175 of which now operate across the state.

Mississippi is notably the only U.S. medical cannabis program with statutory potency caps written into law: 30% total THC on flower and 60% on concentrates and tinctures. Recreational cannabis remains fully illegal, and Mississippi's citizen ballot-initiative process — the only path that ever got medical cannabis passed in the first place — has been ruled unconstitutional and remains unrestored.

Home Cultivation Is Not Permitted — Even for Patients

All Mississippi cannabis cultivation must occur in licensed, indoor, enclosed, and secured facilities under state law. There is no home-grow allowance for patients or caregivers of any kind, and growing outside the licensed system carries real criminal penalties based on the quantity involved.

Mississippi patients should also know the medical card offers limited workplace protection — employers can legally fire, refuse to hire, or discipline someone solely for lawful medical cannabis use, and a medical card is not a defense against a DUI charge or denial of workers' compensation.

Where Things Stand in 2026

Two medical cannabis expansion bills, House Bill 895 and House Bill 1152, passed the Mississippi Legislature by veto-proof margins in early 2026 — but Governor Reeves vetoed both on March 26, 2026. HB 895 would have extended how long medical recommendations and ID cards stay valid; neither bill addressed home cultivation. Separately, legislative efforts to restore Mississippi's citizen ballot-initiative process — which the state Supreme Court invalidated in 2021 — also failed to advance in 2026.

Mississippi's approach mirrors much of the Deep South, but stands in real contrast to states like Missouri, where registered adults can grow up to 6 flowering plants at home. Mississippi's medical program offers no equivalent path for its 67,000+ patients.
