Nevada voters approved recreational cannabis legalization in November 2016 through Question 2, with sales launching in July 2017. But Nevada's home cultivation law comes with a restriction that catches many residents off guard, so it's worth understanding clearly before you order.
Is It Legal to Grow Cannabis Clones in Nevada?
Only if you live more than 25 miles from the nearest licensed dispensary. Nevada law (NRS 453.339) permits adults 21 and older to cultivate up to 6 plants per person, with a household maximum of 12 plants, but only in areas without a licensed retail store within 25 miles. Given how densely Nevada's dispensary network covers its population centers, this rule effectively rules out home cultivation for most residents of Las Vegas, Henderson, North Las Vegas, and the broader Clark County area, as well as Reno and Sparks in Washoe County. Rural Nevada — much of Nye, Lincoln, White Pine, Elko, and Humboldt counties among others — is where this right is genuinely usable.
Registered medical patients get one additional accommodation: those who can document they're unable to travel to a dispensary due to a qualifying health condition or transportation barrier may be eligible to cultivate regardless of proximity, with up to 12 plants permitted. Growing without qualifying under either path is a felony, with penalties scaling by plant count.
