The program remains tightly limited: the state caps licensing at just 4 cultivators statewide, each restricted to 1,250 flowering plants, with up to 12 dispensaries distributed by judicial district. Approved products are limited to non-smokable, non-vapeable forms — oral tablets, tinctures, oils, topical creams, transdermal patches, and suppositories. Raw flower and traditional edibles remain prohibited. Registered patients can possess up to 5 ounces per 30-day period, with a separate cap of 5 grams of delta-9 THC from any single dispensary within 90 days.
Recreational cannabis remains fully illegal in Nebraska. The state did decriminalize small amounts back in 1978 — one of the earliest states to do so — meaning first-offense possession under an ounce is treated as a $300 infraction rather than a criminal charge, though larger amounts still carry real criminal penalties.
Home Cultivation Is Not Permitted for Anyone
Both Initiative 437 and its companion measure explicitly exclude home cultivation. Patients must obtain cannabis exclusively through the licensed dispensary system once it becomes fully operational — there is no path for patients or caregivers to grow their own plants.
Where Things Stand in 2026
Nebraska's program is genuinely ground-floor as of 2026 — the commission issued its first cultivation licenses only in late 2025 and early 2026, and the first state-licensed grower began planting mid-2026 with an eye toward an October harvest. A 2026 bill, LB 1235, shifted the program from a registration model to a stricter licensure model with expanded commission enforcement powers, and a legal challenge to the program's structure was still before the Nebraska Supreme Court as of this writing.
