New York's home grow law, in plain terms
New York legalized adult-use cannabis under the Marijuana Regulation and Taxation Act (MRTA) in 2021, and home cultivation rules took effect in June 2024. Adults 21 and older may grow up to three mature and three immature cannabis plants per person, with a household cap of six mature and six immature plants (12 total) no matter how many adults live there. Unlike several other legal states, New York applies no distance-from-dispensary restriction and no county-by-county carve-out: the rule is the same whether you're in Manhattan, Buffalo, or a small town in the Adirondacks — a real contrast to Nevada's 25-mile rule, for example.
Where and how you can grow
Plants must be grown at your primary residence, in a space used exclusively by your household, kept secure and out of reach of anyone under 21, and not visible from a public place. That last requirement applies to outdoor grows specifically — a fenced yard or an enclosed greenhouse satisfies it, while cultivation visible from the street or a neighboring property does not. Shared spaces like building hallways, communal courtyards, or a shared backyard don't qualify as your exclusive-use area, which matters for New York's large renter population living in multi-unit buildings.
Renters, landlords, and local rules
New York state law doesn't require you to disclose a home grow to your landlord, but landlords can prohibit cultivation through lease terms, and residents of federally subsidized housing cannot grow at all because cannabis remains federally illegal. Local municipalities are allowed to regulate how home cultivation operates within their borders — zoning, odor control, and noise provisions are common examples — but under state law, a municipality cannot ban personal home cultivation outright the way some can opt out of hosting a retail dispensary.
Medical patients
New York's medical cannabis program was significantly expanded in November 2025: certification periods extended from one year to two, out-of-state medical patients gained purchasing reciprocity, and the minimum age for medical-patient home cultivation dropped from 21 to 18. Medical patients follow the same plant-count limits as recreational growers, though registration gives them OCM documentation that can help resolve questions if they ever come up.
