Kentucky's medical cannabis program is one of the newest in the country, having only launched patient registration in January 2025 — but even as it grows, home cultivation remains illegal in Kentucky for everyone, including registered patients.
Is Cannabis Legal in Kentucky?
Medical marijuana is legal for qualifying patients under Senate Bill 47, signed into law by Governor Andy Beshear in March 2023. The program officially launched January 1, 2025, and Kentucky's first licensed dispensary, The Post in Beaver Dam, opened its doors December 13, 2025. As of early 2026, the state has 8 operational dispensaries and 8 licensed cultivators, serving nearly 17,000 active cardholders.
Registered patients can possess up to a 30-day supply of cannabis, with THC limits set at 35% for flower, 70% for concentrates, and 10mg for edibles. One notable restriction: Kentucky prohibits smoking cannabis entirely. Raw flower is available at dispensaries, but patients may only consume it by vaporization — combustion is illegal for everyone, including registered patients.
Recreational cannabis remains fully illegal in Kentucky. Without a valid medical card, possessing under 8 ounces is a Class B misdemeanor carrying up to 45 days in jail and a $250 fine, with penalties increasing for larger amounts.
Home Cultivation Is Not Permitted — Even for Patients
Kentucky's medical program requires all cannabis to come from licensed dispensaries. Growing your own plants is not permitted under any circumstance, even for registered patients with a valid medical card.
Where Things Stand in 2026
Kentucky's program continues to expand access — Governor Beshear signed Executive Order 2026-318 on June 2, 2026, broadening qualifying conditions, though the order was later rescinded on June 15. A separate bill, House Bill 401, which would have allowed limited home cultivation alongside expanded qualifying conditions, was introduced in the 2026 session but never received a committee hearing. A recreational legalization bill was also introduced in January 2026, proposing a 5-plant home grow allowance for adults, but it has not advanced.
Kentucky's ban on home cultivation stands out even among nearby states — both Illinois and Missouri permit registered growers to cultivate at home, something Kentucky's new medical program doesn't offer patients.
