Cannabis Laws in Delaware: What You Need to Know

Delaware is a fully legal adult-use cannabis state — but it stands out from most legal states in one important way: home cultivation is banned for everyone in Delaware, recreational users and medical patients alike.

Is Cannabis Legal in Delaware?

Yes. Delaware legalized adult-use cannabis in April 2023 when Governor John Carney allowed House Bills 1 and 2 to become law without his signature, after both passed the legislature by veto-proof supermajorities. Adults 21 and older may legally possess up to 1 ounce of cannabis flower, 12 grams of concentrate, or products containing up to 750mg of Delta-9 THC. Retail sales launched August 1, 2025, through licensed dispensaries — many converted from Delaware's existing medical program, which has operated since 2011.

Delaware also allows adults to gift cannabis to one another within possession limits, as long as it isn't tied to a purchase or payment of any kind.

Home Cultivation Is Not Permitted — For Anyone

Unlike the majority of legal adult-use states, Delaware's legalization law explicitly excludes home cultivation. This was a deliberate legislative choice — House Bill 1 legalized possession but stopped short of allowing individuals to grow their own plants, and the medical marijuana program never permitted home grow either, even for registered patients.

Cultivating cannabis outside Delaware's licensed system remains illegal and can result in criminal penalties, including felony charges depending on the scale of cultivation.

Where Things Stand in 2026

Delaware's adult-use market is still in its rollout phase, with new retail, cultivation, and manufacturing licenses being issued and conditional licensees working toward becoming operational. As of 2026, there's no active legislative effort to add a home-grow allowance — the state's regulatory approach has focused on building out its licensed retail and cultivation system rather than personal growing rights.

Delaware's neighbor Maryland, for comparison, allows any adult 21+ to grow up to 2 plants at home — a modest allowance, but one that highlights how unusual Delaware's full cultivation ban is among East Coast legal states.
