Is Cannabis Legal in Tennessee?

No. Marijuana is fully illegal in Tennessee for both medical and recreational use. The only exception is a narrow 2015 law, expanded in 2021, allowing patients with qualifying conditions like epilepsy to possess CBD oil containing up to 0.9% THC — but there's no in-state production or dispensing system to actually obtain it, so patients have to source it from other states. Possessing any amount of marijuana above that threshold is a criminal misdemeanor, one of the more severe simple-possession penalties in the country.

Home Cultivation Is a Felony — No Exceptions

Unlike neighboring Missouri or Virginia, Tennessee has no personal-use cultivation exception whatsoever. Growing even a couple of plants can be charged as a felony with real prison time on the table, and penalties scale up further with plant count and weight.

Tennessee's cannabis landscape shows real signs of movement, even without any legislation passing yet. A bipartisan proposal, the Freedom to Farm Act, was introduced ahead of the 2026 session by Republican Senator Janice Bowling and Democratic Representative Antonio Parkinson — a notable pairing in Tennessee's Republican-controlled legislature. The bill would create a registration process through the Department of Agriculture allowing one adult per household to grow up to 15 plants (5 seedling, 5 intermediate, 5 flowering) for personal use, without establishing any commercial market. As of May 2026, it hasn't advanced through committee. Two other 2026 bills — SB 2097 and SB 0960 — would put binding or advisory medical cannabis questions directly to voters in November 2026, though neither has advanced either. Tennessee's position is becoming increasingly isolated: Missouri went fully recreational in 2023, and even neighboring Kentucky passed medical cannabis that same year.
