Is Cannabis Legal in Texas?

Medical cannabis is legal through the Texas Compassionate Use Program (CUP) for patients with a qualifying condition. House Bill 46, signed by Governor Greg Abbott in June 2025 and effective that September, significantly expanded the program — adding chronic pain, Crohn's disease, traumatic brain injury, terminal illness, and hospice care to the qualifying conditions list, raising THC dosage limits, and growing the number of licensed dispensaries from just 3 to as many as 15. Texas doesn't issue physical medical cards; instead, a registered physician enters the prescription directly into a state database.

Recreational cannabis remains illegal, with some of the harshest penalties in the country — cultivation is prosecuted under the same possession framework, scaled by plant weight, and can escalate all the way to a first-degree felony for larger amounts. Texas has also been at the center of a major fight over hemp-derived THC products: the legislature passed a ban in 2025, Governor Abbott vetoed it and called two special sessions that ended without a deal, then issued an executive order to regulate the hemp market through agency action instead. A subsequent March 2026 rule banned smokable hemp products from retail specifically, though edibles, tinctures, and topicals remain available under separate hemp law.

Home Cultivation Is Not Permitted — Even for Patients

Texas's Compassionate Use Program supplies patients exclusively through licensed dispensing organizations; there is no home-grow provision anywhere in the medical program, and recreational users have no cultivation rights either. Growing cannabis in Texas is treated the same as possession, meaning even a handful of plants can push a grower into felony territory once aggregate weight is factored in.

Where Things Stand in 2026

Texas's medical program is more credible today than it's been in years following HB 46's expansion, and hemp cultivation itself remains legal with a Texas Department of Agriculture license — a separate track from marijuana entirely. But marijuana home cultivation isn't part of that conversation; the state's regulatory energy has gone toward expanding licensed dispensing and managing the hemp market, not toward personal-use cultivation rights.
