Cannabis Laws in Idaho: What You Need to Know

Idaho has the distinction of being one of the strictest cannabis states in the country — it's one of the few states with no medical marijuana program, no decriminalization, and no legal path to cannabis of any kind, including home cultivation.

Is Cannabis Legal in Idaho?

No. Idaho law prohibits the possession, sale, and cultivation of all forms of cannabis, with no exceptions for medical use. Idaho's legal definition of marijuana under state code covers any part of the cannabis plant and any derivative containing any detectable amount of THC — even hemp-derived CBD products must contain 0.0% THC to be legal in the state, a stricter standard than the federal hemp threshold.

Idaho doesn't recognize out-of-state medical marijuana cards, and as of July 2025, House Bill 7 made Idaho the only state with a mandatory minimum fine for simple possession — anyone convicted of possessing under 3 ounces must pay at least $300, with judges no longer able to waive it.

Home Cultivation Is Not Legal Under Any Circumstance

With no medical or recreational program in place, there is no legal framework in Idaho that permits growing cannabis at home for any reason.

Where Things Stand in 2026

Idaho may be on the verge of a major shift. The Natural Medicine Alliance of Idaho collected over 150,000 signatures — well beyond the 70,725 required — to place the Idaho Medical Cannabis Act on the November 3, 2026 ballot. If approved by voters, the measure would create a regulated medical cannabis program allowing patients with qualifying conditions to access smokeable, inhalable, and ingestible cannabis products through licensed dispensaries starting in 2027.

The initiative faces a notable complication: a separate measure, House Joint Resolution 4, would amend the Idaho Constitution to give the legislature exclusive authority over cannabis legalization and prohibit future citizen-led cannabis initiatives — potentially closing this path for future reform even if the current measure fails. Both could appear before voters this November.

Idaho's total prohibition is increasingly rare regionally — neighboring Nevada allows recreational adults to grow up to 6 plants at home, a right Idaho doesn't extend to anyone, medical or otherwise.
