Is Cannabis Legal in Kansas?

No. Kansas has no medical or recreational cannabis program, and the state maintains full prohibition on any cannabis product containing more than 0.3% THC. The only real concession came in 2018 with Claire and Lola's Law (SB 282), which offers an affirmative legal defense for possessing low-THC CBD oil for individuals with seizure disorders — but it created no legal way to actually obtain that oil within the state. Kansas does allow industrial hemp cultivation and hemp-derived products at or below 0.3% THC, in line with the 2018 federal Farm Bill.

Possessing any amount of marijuana in Kansas is a criminal offense right now, and out-of-state medical marijuana cards carry no legal protection here.

Home Cultivation Is Not Legal Under Any Circumstance

Kansas lawmakers have introduced medical marijuana legislation in at least three consecutive legislative cycles, and each attempt has stalled. The most recent, Senate Bill 294 (the Kansas Medical Cannabis Act), died in the Senate Committee on Federal and State Affairs on April 10, 2026. Two newer proposals — House Bill 2678 (a medical cannabis framework) and House Bill 2679 (an adult-use framework) — were introduced in February 2026 and remain pending in committee. Governor Laura Kelly has expressed support for medical cannabis, and Kansas's position bordering three states with legal programs (Colorado, Missouri, and Oklahoma) continues to add pressure for reform, but no legislation has advanced to a floor vote as of this writing.

Kansas is now surrounded by more permissive neighbors than ever — Missouri allows registered adults to grow up to 6 flowering plants at home, adding pressure for Kansas lawmakers to reconsider the state's current prohibition.
