Is Cannabis Legal in Pennsylvania?
Medical marijuana is legal for qualifying patients under the Medical Marijuana Act, signed by Governor Tom Wolf in April 2016. The program has grown to serve over 439,000 patients through 195 licensed dispensaries statewide. Patients can purchase up to a 90-day supply, tracked electronically through Pennsylvania's "medical marijuana units" system, with smokable flower added to approved forms in 2018.
Recreational cannabis remains fully illegal. Pennsylvania's House passed a legalization bill for the first time in state history in May 2025, but the Senate killed it in committee shortly after. Possession of 30 grams or less is a misdemeanor carrying up to 30 days in jail and a $500 fine, though Philadelphia and Pittsburgh have locally decriminalized small amounts to a civil fine.
Home Cultivation Is a Felony — Even for Patients
Growing any amount of cannabis in Pennsylvania, even a single plant, is a felony carrying 2.5 to 5 years in prison and up to a $15,000 fine. This applies equally to registered medical patients — there is no cultivation carve-out in the medical program, and a cultivation conviction also triggers an automatic driver's license suspension.
Where Things Stand in 2026
Pennsylvania has several cannabis bills currently moving through the legislature. Senate Bill 76, introduced in January 2025, would allow registered medical patients 21 and older to cultivate their own plants, but remains stuck in Senate committee. A newer proposal, Senate Bill 120, would establish a private-retail adult-use market with a 14% combined tax rate and would permit registered medical patients to grow up to 5 plants at home — it remains in the Senate Law & Justice Committee as of February 2026. Governor Josh Shapiro has publicly supported legalization, and momentum has been building, but no bill has passed both chambers as of this writing.
