Cannabis Laws in Georgia: What You Need to Know

Georgia's medical cannabis program just underwent its biggest overhaul since it began in 2015 — but even with the changes, one rule hasn't moved: home cultivation remains illegal in Georgia for everyone, including registered medical patients.

Is Cannabis Legal in Georgia?

Medical cannabis is legal for qualifying patients, but the program has historically been one of the most restrictive in the country. That changed significantly with Senate Bill 220, the "Putting Georgia's Patients First Act," which took effect July 1, 2026. The law renamed the state's "Low THC Oil Registry" to "Medical Cannabis," removed the old 5% THC cap in favor of a 12,000mg possession limit, expanded qualifying conditions, and — for the first time — legalized vaporization, including vaporizable flower.

Recreational cannabis remains fully illegal in Georgia. Marijuana is a controlled substance under state law, and possession, sale, and cultivation outside the medical program are criminal offenses. Some cities, including Atlanta, have local ordinances reducing penalties for small possession amounts, but this doesn't change state-level illegality.

Home Cultivation Is Not Permitted — Even for Patients

Georgia licenses just six companies to cultivate medical cannabis statewide, split between Class 1 licenses (up to 10,000 sq ft of indoor cultivation) and Class 2 licenses (up to 50,000 sq ft). All product must move through this tightly controlled system to licensed dispensaries. Registered patients can purchase and possess medical cannabis, but the law does not extend any right to grow it themselves — home cultivation remains a criminal offense regardless of patient status.

Where Things Stand in 2026

With SB 220's changes rolling out through mid-2026, Georgia's medical cannabis program is expected to see significant growth — officials have projected the patient count (nearly 36,600 as of mid-2026) could triple by 2027 as the rebranded, higher-potency program becomes more appealing. Despite this expansion, there's no indication home cultivation is under legislative consideration. Georgia's regulatory approach continues to center on its limited-license commercial system rather than personal growing rights.

Georgia's approach mirrors much of the Southeast, but stands in real contrast to states like Missouri, where registered adults can grow up to 6 flowering plants at home. Georgia's newly expanded medical program still offers no equivalent path for patients.
