Understanding Florida's Medical Marijuana Program and Home Cultivation Ban

Florida has one of the largest medical marijuana programs in the country, but it also has one of the strictest stances on home cultivation: growing cannabis is illegal in Florida for everyone, including registered medical patients, and carries felony penalties.
Is Cannabis Legal in Florida?
Medical marijuana is legal for qualifying patients under Amendment 2, approved by voters in November 2016. Patients with a qualifying condition and physician certification can register with the Office of Medical Marijuana Use (OMMU) and purchase from licensed Medical Marijuana Treatment Centers (MMTCs), of which there are only 27 operating statewide as of this writing.
Recreational cannabis remains illegal in Florida. A 2024 ballot initiative (Amendment 3) that would have legalized adult-use cannabis fell short of the required threshold, and as of 2026, no recreational legalization effort is active in the legislature. Without a medical card, any amount of marijuana is a criminal offense.
Home Cultivation Is a Felony — Even for Patients
Florida's medical program is built entirely around licensed cultivation. The only legal way to grow cannabis in the state is to own and operate a licensed MMTC — an option unavailable to individual patients. Growing even a single plant outside this system is a third-degree felony, carrying up to 5 years in prison and a $5,000 fine, with penalties increasing significantly for larger grows.
This applies equally to registered medical patients. Holding a valid medical marijuana card allows a patient to purchase and possess cannabis, but it does not create any exception for home cultivation.
Where Things Stand in 2026
Florida lawmakers have made repeated attempts to add a limited home-grow allowance for medical patients. Most recently, Senate Bill 776 — which would have permitted qualified patients to cultivate up to six flowering plants — died in the Health Policy committee in March 2026 without advancing. A similar proposal from Senator Joe Gruters in a prior session also failed to gain traction. As of this writing, no active bill is expected to change Florida's cultivation ban in the near term.
Florida's cultivation ban stands in contrast to states like Michigan, where any adult 21+ can grow up to 12 plants at home with no card required. Florida's medical program, despite serving hundreds of thousands of patients, offers no equivalent path.
